Terms & Conditions

Welcome to incight.org (the “Site”), operated by INCIGHT (“INCIGHT,” “we,” “us,” or “our”), a U.S. nonprofit organization headquartered in Portland, Oregon. These Terms & Conditions (the “Terms”) govern your access to and use of the Site, our digital properties, and any related programs, content, or services offered through them (collectively, the “Services”). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. About INCIGHT

INCIGHT is a nonprofit organization that advances leadership, education, employment, and community for people with disabilities. We operate scholarship programs, mentor programs, the INCIGHT Leader Academy, entrepreneurship initiatives, and a range of community and convening programs (collectively, the “Programs”).

2. Eligibility

The Services are intended for users aged 13 and older. Users under 18 should have a parent or legal guardian review these Terms and the related notices before using the Services. Some Programs have additional eligibility requirements, which are described on the relevant program pages.

3. Acceptable use

You agree to use the Services only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • use the Services to violate any applicable law or regulation;
  • upload or transmit any content that is unlawful, harassing, defamatory, discriminatory, threatening, obscene, or otherwise objectionable;
  • infringe any third party’s intellectual property, privacy, publicity, or other rights;
  • attempt to access any portion of the Services that you are not authorized to access, or interfere with the operation or security of the Services;
  • use any robot, scraper, or automated means to access or copy the Services without our prior written consent;
  • impersonate any person or misrepresent your affiliation with any person or organization.

We reserve the right to investigate and respond to suspected violations, including by suspending or terminating access.

4. Program applications and participation

Program applications submitted through the Site are reviewed under the eligibility criteria and selection process published on the relevant program pages. Submission of an application does not guarantee acceptance into any Program. Program participants may be required to agree to additional terms specific to that Program, including conduct expectations, attendance requirements, and reporting obligations. Decisions regarding selection, continuation, and benefits are made at INCIGHT’s discretion.

5. Donations

Donations made through the Services are processed by our third-party payment processors. INCIGHT is a U.S. tax-exempt nonprofit organization; eligible donations may be tax-deductible to the extent permitted by U.S. law. No goods or services are provided in exchange for donations unless expressly stated. Donations are generally non-refundable. If you believe a donation was made in error, contact us within 30 days and we will review the request in good faith. Recurring donations may be cancelled at any time by contacting scott@incight.org.

6. User submissions

If you submit a message, story, application, or any other content to INCIGHT through the Services (“User Submissions”), you represent that you own or have the necessary rights to submit that content and that it does not violate these Terms or any third-party rights. You grant INCIGHT a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, reproduce, and display the User Submission for the purpose of operating the Services and carrying out our mission. We will obtain your express consent before using any User Submission that personally identifies you in marketing or fundraising materials.

7. Intellectual property

The Site and its contents — including text, graphics, photographs, video, audio, logos, trademarks, and underlying source code — are owned by INCIGHT or its licensors and are protected by U.S. and international copyright, trademark, and other laws. Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, publicly display, publicly perform, republish, or create derivative works from any portion of the Services without our prior written consent.

“INCIGHT,” the angled-i wordmark, and related taglines are trademarks of INCIGHT. Other names, logos, and trademarks referenced on the Services are the property of their respective owners.

8. Third-party links and services

The Services may contain links to third-party websites, services, or resources (for example, JobsNow.org, social media platforms, or payment processors). We provide those links for convenience only and do not control or endorse the linked third parties. Your use of any third-party website or service is governed by the terms and policies of that third party, and INCIGHT is not responsible for their content, products, or practices.

9. Accessibility

INCIGHT is committed to making the Services accessible to the broadest possible audience, including people with disabilities. We aim to align with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA and continually improve. If you encounter an accessibility barrier, please contact scott@incight.org and we will work to address it.

10. Privacy

Your use of the Services is also subject to our privacy practices. We collect only the information needed to operate the Services, respond to inquiries, process donations, and administer Programs. We do not sell personal information. For specific questions about how your information is handled, contact scott@incight.org.

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. INCIGHT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT INFORMATION ON THE SERVICES IS COMPLETE OR CURRENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL INCIGHT, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. INCIGHT’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless INCIGHT and its directors, officers, employees, volunteers, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Services, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including for any conduct that we believe violates these Terms or is otherwise harmful to other users, INCIGHT, or third parties. The provisions of these Terms that by their nature should survive termination will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Oregon, U.S.A., without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to the personal jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Effective date” at the top of this page. Material changes will be communicated through the Services or, where appropriate, by other reasonable means. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

17. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with any policies referenced here, constitute the entire agreement between you and INCIGHT regarding the Services.
